While raising children in modern times is heavily geared toward parents providing nearly all childcare, there are still times when other adults play significant roles in children's lives. Those people often include grandparents, other close relatives, and even family friends. Often, parents have relationships with those individuals that naturally allow children to see them. Much of the time, this kind of informal arrangement works great for family structures. Unfortunately, not all families can work together so easily. Some parents do not get along with their family members, including their children's grandparents, which can result in numerous childrearing disputes. A more common situation arises when one or both of the parents struggles with a substance abuse disorder that prevents them from providing the parenting the children need to succeed. When this happens, someone else may want to step in and fill this role for the child. In other rare but unfortunate situations, parents may unexpectedly pass away, leaving children needing long-term caregiving. These situations can lead grandparents and other individuals to request custody or visitation with someone else's children. What is spousal support (alimony) in Ohio? The Ohio Revised Code describes alimony as any payment or payments to be made to a spouse or former spouse. This can also include payments to a third party for the benefit of the spouse or former spouse. Alimony can be a contentious ordeal to finalize for both parties. During the course of a legal separation, either the two parties come to an agreement regarding the alimony distribution or the judge will decide for them. The Ohio Court of Common Pleas looks at both spouses’ individual financial, social, and personal circumstances when determining how and what type of spousal support to award. See more on how alimony is calculated below. In addition, alimony does not necessarily imply a purely monetary remittance. An award of spousal support (alimony), may be allowed in the form of personal property or a decree of a lump sum of money. Alimony payments can also occur as installments over a period of time or as one lump sum. The court will attempt to find a fair and equitable amount, but it is imperative to handle... --- > You will need a motion to modify spousal support in Ohio if you are looking to make changes to your spousal support (alimony) agreement/payments. Unless there has been an explicit condition set in place during the first spousal support suit, a participating party member has the right to ask for a modification of spousal support in Ohio. After a divorce, the court, after considering the circumstances of each party, could decree some sport of support. A party may be required to pay spousal support (alimony) and/or child support. With all of these factors involved, a former spouse could potentially be responsible for giving up a large portion of his or her income. After spousal support has been granted by the Ohio Court of Common Pleas, the circumstances surrounding the lives of the party members may change. Life is not always a constant when handling a divorce case. For example, one ex-spouse may lose their job or may receive a pay raise since the first spousal support decree. If you would like to modify spousal support in Ohio due to retirement, job loss, request for higher support, or request for payment of a lower amount, a motion to modify spousal support must be filed... --- > Looking for the best annulment attorneys near Columbus OH? For - Published: 2018-09-21 - Modified: 2021-09-13 - URL: https://www.columbusfamilylaw.org/divorce/equitable-distribution/ Equitable Distribution In Ohio and the rest of the United States, ending a marriage begets another set of marital issues that must be resolved. For example, ex-spouses may be called upon to decide who will take custody over any children and what if one of the spouses moves out of state? Will one of the ex-spouses be required to pay alimony to the other? Lastly, who will get to ownership of the house or other valuable assets? These questions usually cause the most controversy in cases of marriage separation. The Ohio court of common pleas takes very close and special consideration before allocating the results. The basic rule of Ohio law requires that the court look at all the assets accumulated during the marriage, by both spouses' efforts, and distribute it equitably. It does not matter whether a spouse owned a certain asset; like an existing pension account under only one of the spouse’s names, for example, will be divided equally. Unless both parties have signed a pre-marital agreement, the court will consider all property in possession of both parties and determine which property will be considered separate property and which will be considered marital property. Can an annulment be given? Should spousal support be awarded? What about child support? Who should retain control of the marital property? Not only do a lot of factors bear weight in the conversation of determining post-marital support, but the laws of Ohio also require spouses to adhere to this marital obligation as well. Ohio Statute § 3103. 03 requires each spouse in a marriage to support the other with either property or labor. The requirement also includes an obligation to provide for any minor children. In Ohio, the biological or adoptive parents of a minor child must care for that child through housing and labor. As long as he or she attends an accredited high school on a full-time basis, the parent must provide support. These sorts of rulings can be difficult to determine. There's a multitude of circumstances that must be observed. Not to mention the obligation of support is very serious in the state of Ohio. While co-parenting comes with its share of complexities, co-parenting effectively can provide a healthy and nurturing environment for your children. Understanding Co-Parenting Co-parenting, at its essence, involves both parents actively participating in their children's lives, working to meet their needs, and maintaining strong relationships. Unless complicated by issues like domestic violence or substance abuse, co-parenting is widely regarded as the best approach to ensure a child's healthy development. The quality of the co-parenting relationship significantly influences children's mental and emotional health, impacting their self-esteem and resilience. Making Co-Parenting Work Successful co-parenting requires separating personal feelings from the co-parenting relationship. It entails prioritizing children's needs over individual grievances, reframing the relationship with your ex through a new lens solely centered on your children's welfare. Even though your marriage has ended, your family still needs to be your top priority. Putting your children's needs before your own is the first step toward being a responsible and mature co-parent. Schoolyard bullies have been a problem for generations, and today's children still have to deal with them, although the tactics bullies use have evolved. Whether bullying happens in physical or verbal form or online, the psychological effects of being bullied can be long-lasting, affecting a child's self-esteem as well as their performance in school. However, taking action to stop bullying behaviors can minimize these effects. The first step toward addressing and preventing bullying is being able to recognize it. Bullying isn't always easy to spot to those who aren't being bullied. Things to look for include changes in a child's personality or eating habits, headaches, stomachaches, reluctance to go to school, declining grades, lost or destroyed belongings, or unexplained injuries. When these behaviors go unchallenged, they can seem acceptable to children, which is why it's important to start teaching kids about the dangers of these addictive substances from a young age. Children should be able to recognize what these things are, what their effects can be, and why they're dangerous. It's also crucial to teach kids that even infrequent use of drugs or alcohol can lead to serious consequences. Teaching kids about why they should avoid drugs and alcohol and equipping them with strategies to do so can help to keep them safe and healthy, both now and in the future. Types of Drugs Cigarettes Smoking cigarettes was once quite common and even viewed as glamorous, but now, we understand that cigarettes are highly addictive and can cause serious damage to your health. As smoking has become less prevalent, however, it's been replaced by vaping, which still involves inhaling addictive nicotine and other dangerous chemicals. Of course, kids usually struggle greatly when their parents split up, and these struggles may be emotional, psychological, or academic. It's easier to dismiss the ramifications of divorce on adult children. However, studies indicate that grown children of divorce also struggle in important ways. Gray Divorce Gray divorces are divorces that happen when the spouses are over age 50. By the time two people have been married for this length of time, they have usually established a large network or community of acquaintances, friends, and extended family. The divorce effectively shatters this community, which affects not only the divorcing spouses but their adult children as well. Adult children may feel a loss of identity when the marriage fails. They may also wonder about the family unit they grew up in and whether it was just a big show for the world. Losing important family traditions and togetherness, imagining very different future events like weddings and graduations with the fractured family, losing touch with extended family, and losing the family home can all be very significant sources of pain and grief. Unfortunately, that isn't always how marriage plays out, as roughly 30% of couples between people 20 years of age and older end up in divorce. When a marriage ends, it is often at great emotional and financial cost. Although the emotional toll of divorce is to be expected, the financial consequences might be higher and more complicated than some realize. The cost of obtaining a divorce, for example, can be as much as $20,000 or more. These costs include hiring an attorney and complications involving finances. These complications are often associated with the divorce settlement. Various parts of the settlement can be costly and difficult for both parties to agree on. Although one's financial responsibility regarding the settlement terms is often court-determined, it is important to understand what they are and what to consider when filing for a divorce. Spousal Support Spousal support, which is also known as alimony, is one of the most contentious parts of a divorce settlement. Alimony is the payment of a predetermined amount of money from one spouse to another. Often, when two people dissolve a marriage, it drastically changes not just their lives, but the lives of their children as well. The children of divorced parents undergo their own emotional journey as they adjust to their new reality. When either parent remarries, this creates a new dynamic for everyone, particularly when other children are involved. When two people who each have one or more children from a prior relationship marry, they create a new family unit. This is called a stepfamily or blended family. Although blended families aren't new or uncommon, they do come with their own set of challenges. To best handle these challenges and create a successful and cohesive household, it's important people know what they're getting into and properly prepare. Have a Plan for Remarriage Jumping into a marriage that combines two families can have chaotic and less-than-desirable results. Without a plan, the new family dynamic may suffer from more stress and unease than is necessary. When the prospect of marriage becomes more than a passing thought, there are things that the couple needs to consider and prepare for. There have not been significant changes in federal law in these issues, and no high-profile Supreme Court cases like Obergefell have yet forced a reconsideration of existing laws and statutes. Divorce is rarely simple when there are children involved because family law dictates that a custody arrangement be devised that is in the best interest of the child(ren). When one or both parents is lesbian, gay, bi, or transgender, a child custody case often becomes more complicated due to the legal relationships between family members and the possibility of discrimination. The guideline used to determine custody of children should be to serve their best interests. As is often the case, one of the partners may have a biological connection with the children, while the other partner may not a blood relation. Consequently, when it's time to determine the legal rights of both partners for custody and visitation, the partner without a biological connection may be left with no legal standing in the eyes of the law. The NPO’s cites research that shows a correlation between benefits to the mental health of children of divorce and equal parenting time as part of its conclusion. Ohio county courts of domestic relations have default guidelines regarding how to split divorced parents’ time with their children when the parties cannot agree otherwise. The report found that the majority of default parenting time guidelines were short of what is recommended by research which recommend equal time for both parents. In fact, the vast majority of Ohio’s counties, 64 of 88, allow children only two overnight stays and 60 hours or less with the non-residential parent. The overnight stays were also limited to weekends. Only three Ohio counties allowed for near equal or equal time with the non-residential parent. A recent study by the University of Maryland shows an 18 percent drop in the divorce rate between 2008 and 2018. This trend, however, does not apply to a certain demographic though, older Americans. In fact, adults 50 and older are actually divorcing at double the rate they were in the 1990s. Adults age 65 and older are divorcing at three times the rate of the 1990s. The reasons for the so called “gray divorce” phenomenon have not been explored extensively but at least one study in the Journals of Gerontology, has found that traditional divorce factors common among younger adults also applies to the older crowd. The researchers expected that stress factors such as empty nest syndrome, retirement of a spouse, and chronic health conditions that would be common to older Americans, would explain the high divorce rate for those 50 and older.
